Third Ave. and set on fire, said assistant Camden County Prosecutor James Faison of the Arson Squad.

"There was a fairly broad stain around the base of the house along the side," Faison said yesterday. The stain pattern, he said, was evidence a flammable accelerant had been used. He was 75. Spivak, whose theme song was "Stardreams," died at his home outside Caesar's Head near the North Carolina border.

Born in Kiev, Ukraine, on Feb. 17, 1907, Spivak came to the United States when he was 3 and was raised in New Haven, Conn. He began playing the trumpet when he was 16. Spivak gained fame as a sideman in the bands of Tommy and Jimmy Dorsey, Jack Teagarden, Ray Noble, Bob Crosby and Ben Pollack. Spivak realized his dream of starting his own band in 1941, with the aid of a man he called his "guardian angel," fellow band leader Glenn Miller.

After 17 successful years on the road, the 27-member Charlie Spivak Band located in Miami, Fla. But in 1967, Spivak gave his first performance at Ye Olde Fireplace in Greenville, and the next year, he started a two-week engagement that lasted 11 Vz years. Survivors include his wife, Wilma H. "Dubby" Spivak, two daughters, two sons, a stepson, two sisters and DUNNER George 1 Cornell Glassboro, N.J. on March 1, 182.
