The resolution, however, becomes effective only if the court approves it. The council voted to fire Gary Covely last month, accusing him of failing to submit state-mandated financial disclosure forms. That dismissal was to be made effective Feb. 2.

Covely and his lawyer, Robert Kennedy of Woodbury, appealed the dismissal to Superior Court Judge Samuel G. DeSimone, who set a Feb. 20 hearing to decide whether the council had the authority to dismiss the vice chairman. Councilwomen Linda Cunard and Bea Cerkez, the two dissenters in the January vote to remove Covely, voted against passing the resolution during Wednesday's meeting. They questioned Township Solicitor Carl Viniar about the need to pass the resolution considering the matter is still in court.

Viniar informed the two the resolution was simply a "written resolution" verifying Covely's removal and that the resolution 1 was subject to the orders of the court. In other business Wednesday, the council voted to introduce the 1997 budget by a 5-0-2 vote. Both Cunard and Cerkez abstained citing they had just received copies of the budget, which were prepared by township manager Joseph Picardi. The budget, which will be up for vote during a public hearing on March 26, calls for a two-cent increase. The current tax rate? is .47 per $100 of assessed valuetion.

The increase would give the owner of a home assessed at $100,000 a $20 tax hike. That homeowner currently pays $4701 in local property taxes.
